Terms of Service

These Terms of Service ("Terms") govern your use of FastSeas's weather routing and passage planning tools, available via our website and our satellite email gateway (together, the "Service"), provided by Extempo LLC, a Wyoming limited liability company doing business as FastSeas ("FastSeas," "we," "our," or "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

The Service

FastSeas calculates suggested sailing/motoring routes and passage timing using publicly available weather forecasts, ocean current data, and information you provide about your vessel and preferences. It's a planning aid, not a navigation or safety system.

FastSeas is not a substitute for official marine weather forecasts, navigational charts, seamanship, or your own judgment. Weather and ocean-current forecasts are inherently uncertain and can change quickly. You are solely responsible for the safe navigation of your vessel, for verifying conditions using official sources (such as the National Weather Service, NOAA, or your national maritime authority) before and during any passage, and for deciding whether and when it is safe to depart or continue a voyage. Never rely on FastSeas as your only source of weather or routing information, especially for offshore or otherwise higher-risk passages.

Eligibility and Accounts

You must be at least 13 years old to use the Service. You're responsible for keeping your account's associated email or social login secure, and for all activity that happens under your account. Let us know right away if you think someone else has accessed your account without permission.

Subscriptions and Billing

FastSeas offers a free plan with limited use (currently 5 departure-planning requests per month) and paid Premium plans (billed yearly, monthly, or every 6 months). Paid subscriptions are billed in advance through Stripe and renew automatically at the end of each billing period until you cancel. You can view, manage, or cancel your subscription at any time from your Account page. Except where required by law, fees already paid are non-refundable, including for partial billing periods.

We may change our plans or pricing from time to time; if we do, we'll let you know before the change takes effect for your account.

Satellite Email Gateway

If you use FastSeas's satellite email gateway (for example, over a Garmin inReach, Iridium GO!, Zoleo, or similar device), you're relying on third-party satellite messenger networks that FastSeas doesn't own, operate, or control. We can't guarantee message delivery, timing, or reliability over those networks, and we're not responsible for outages, delays, or failures on the part of your satellite messenger provider.

You retain ownership of the vessel, route, and other information you provide to FastSeas. By using the Service, you give us permission to store, process, and use that information to provide the Service to you, as described in our Privacy Policy.

Intellectual Property

FastSeas and its logo, design, and software are owned by us and protected by applicable intellectual property laws. These Terms don't grant you any rights to our trademarks, branding, or underlying code beyond what's needed to use the Service as intended.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT ROUTING SUGGESTIONS, WEATHER DATA, OR ANY OTHER OUTPUT OF THE SERVICE WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR VOYAGE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTSEAS AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, VESSEL, PROPERTY, PROFITS, OR LIFE OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE - INCLUDING ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON ROUTING OR WEATHER INFORMATION PROVIDED BY THE SERVICE - EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold FastSeas harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.

Termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if we reasonably believe you've violated these Terms, or to protect the Service or other users. Sections of these Terms that by their nature should survive termination (such as Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here with a new "Last updated" date. Continuing to use the Service after a change takes effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Wyoming, and you consent to that jurisdiction.

Miscellaneous

These Terms, together with our Privacy Policy, make up the entire agreement between you and FastSeas regarding the Service. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms isn't a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
